01 Acceptance of Terms

By accessing or using the Exqub Protocol website (exqub.com) and associated services ("Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

02 Description of Services

Exqub Protocol provides:

03 Licensing Model

Exqub Protocol uses a dual licensing model that balances open standards with sustainable development. Different components have different licenses based on their purpose.

04 Acceptable Use Policy

You agree not to:

  • ✗ Use the Services for any illegal or unauthorized purpose
  • ✗ Violate any laws in your jurisdiction
  • ✗ Attempt to compromise the security of our systems
  • ✗ Interfere with or disrupt the Services or servers
  • ✗ Transmit malware, viruses, or harmful code
  • ✗ Misrepresent the origin or ownership of the Exqub Protocol
  • ✗ Use the Services to violate the privacy of others

05 Intellectual Property

Protocol Software

The Exqub Protocol uses a dual licensing model. Most users (integrators building applications) use the code under Apache 2.0 terms. Commercial licenses apply to organizations building competing credential infrastructure products.

Website Content

Unless otherwise noted, website content including text, graphics, logos, and documentation is licensed under Creative Commons Attribution 4.0 International (CC BY 4.0).

Trademarks

"Exqub" and the Exqub logo are trademarks of the Exqub Protocol project. Use of these marks must comply with our brand guidelines.

Contributions

By contributing to the Exqub Protocol, you agree that your contributions will be licensed under the applicable terms. Contributions to dual-licensed components require a Contributor License Agreement (CLA).

06 Disclaimer of Warranties

The Services and Software are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • ✗ Fitness for a particular purpose
  • ✗ Non-infringement
  • ✗ Accuracy, reliability, or completeness
  • ✗ Uninterrupted or error-free operation
  • ✗ Security or absence of vulnerabilities

07 Limitation of Liability

In no event shall Exqub Protocol, its contributors, or affiliates be liable for any:

This limitation applies even if we have been advised of the possibility of such damages.

08 Cryptographic Notice

IMPORTANT: The Exqub Protocol implements post-quantum cryptographic algorithms. Users acknowledge that:

  • • Cryptographic standards may evolve over time
  • • No cryptographic system can guarantee absolute security
  • • Implementation quality affects security properties
  • • Users are responsible for proper key management
  • • Compliance with export control laws is the user's responsibility

09 Export Compliance

The software may be subject to export control laws and regulations. You agree to comply with all applicable export and re-export control laws and regulations, including:

  • • U.S. Export Administration Regulations
  • • International Traffic in Arms Regulations
  • • End-user, end-use, and destination restrictions

10 Indemnification

You agree to indemnify, defend, and hold harmless Exqub Protocol and its contributors from any claims, damages, losses, liabilities, costs, and expenses arising from:

  • • Your violation of any third-party rights
  • • Your violation of applicable laws

11 Privacy

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Delaware, and judgment on the award may be entered in any court having jurisdiction.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

17 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the website, constitute the entire agreement between you and Exqub Protocol regarding the use of our Services.

18 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
